The Mayor's Agent for Historic Preservation Hearing Officer conducted a hearing on June 11, 2015, an appeal of a decision by the Historic Preservation Review Board Hearing of March 18, 2015. The applicant's claim is "that the demolition is consistent with the purposes of the Act and that issuance of the permit is necessary for the construction of a project of special merit and that the failure to issue the raze permit will result in unreasonable economic hardship to the owner".
The Decision and Final Order was issued on December 2, 2015. On December 23, 2015 several recognized parties appealed the Mayor's Agent Decision to the District of Columbia Court of Appeals.
The appeals case remains active.
